We, WHITEHEDGE TECHNOLOGIES PVT. LTD. (“Company” “We”; “us”; “our”) have developed an online portal namely CloudHedge (“Platform”) hosted on our website www.cloudhedge.io (“Website”), that currently provides the cloud based services as set out below to the Users of the Website. The Platform enables automation and management of your hosted application, infrastructure setup, software installation and deployment using the Platform (“Services”).

We are committed to protect your privacy and have made this Privacy Policy to describe the procedures we adhere to for collecting, using, and disclosing the Personal Information (defined below). We recommend you read this Privacy Policy carefully so that you understand our approach towards the use of your Personal Information.

Information

PERSONAL INFORMATION COLLECTED:

This Privacy Policy applies to the Personal Information collected and controlled by the Company from or about you when you avail the Services offered by the Company.

For the purposes of this Privacy Policy, “Personal Information” means information that can be used to personally identify the User, including but not limited to User’s name, address, telephone number, e-mail address, user IDs and passwords, User’s cloud credential keys, contact preferences, and similar information. The Personal Information shall also include details in relation to the business such as name, address, Services details, Services name and description, variants, option types, value of Services subscribed and similar information.

You undertake that you shall be solely responsible for the accuracy and truthfulness of the Personal Information that you share with us.

In the event there is any change in Personal Information of the User, the User will have to log on and update Your User Account information on the Website.

We collect your Internet Protocol (“IP”) addresses when you visit the Website to track and aggregate non-personal information. Data and Security

DATA RETENTION:

We will retain the Personal Information, as long as the User Account is valid and subsisting. We may also retain and use the Personal Information after you stop, cease, discontinue to use or avail the Services, as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements and for our business purposes. Subject to this section, we will try to delete the Personal Information upon reasonable written request for the same. Please note, however, that there might be latency in deleting Personal Information from our servers and backed-up versions might exist even after deletion.

SECURITY:

We value your Personal Information, hence we shall make commercially reasonable efforts to ensure an adequate level of protection. We encrypt sensitive date like passwords and keys before storing. We have therefore implemented technology and policies with the objective of protecting Your Personal Information from unauthorized access and improper use. As a matter of security, we take back-up of systems every day and have sufficient security policies in place to ensure no data is breached. Although we provide appropriate firewalls and protections, our systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible and we take no liabilities or responsibilities for it. All Personal Information shall be securely stored on the server of a paid cloud service provider subscribed to by us.

You are responsible for all actions that take place under the User Account. If you choose to share User Account details and password or any Personal Information with third parties, you are solely responsible for the same. If you lose control of User Account, you may lose substantial control over the Personal Information and may be subject to legally binding actions. It is your responsibility to keep your User Account and password, confidential.

We may have links to other websites and / or application owned and operated by third parties who are not related to the Company on our Website, however these links are merely for your convenience and for providing better Services. We do not advertise these links. We shall not be responsible for the privacy policies and practices of these links. Such links are subject to their respective terms of use and any additional guidelines and privacy information provided in relation to the use on their website. You understand that the Company shall not be a party to any commercial or business transactions which you may enter into with these third -party links.

COMMUNICATIONS FROM THE WEBSITE:

On certain occasions or under law, we are required to send out service or Website related announcements. We respect your privacy, however you may not opt-out of these communications. These communications would not be promotional in nature.

USAGE DETAILS:

Your usage details such as time, frequency, duration and pattern of use, features used and the amount of storage used will be recorded by us in order to enhance your experience of the Services and to help us provide you the best possible Services.

GOVERNING LAW AND DISPUTE RESOLUTION:

This Agreement shall be construed and governed by the laws of Republic of India and the courts at Pune, Maharashtra shall have an exclusive jurisdiction over such disputes.

LIMITATION OF LIABILITY:

You expressly understand and agree that the Company shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, information, details or other intangible losses (even if the Company has been advised of the possibility of such damages) arising out of the terms of this Privacy Policy.
